§ 8-86. Applicability; exceptions.

  • (a)

    Applicability. This Code shall apply to any dwelling or part thereof which is occupied by persons pursuant to an oral or written rental agreement for monetary compensation. These shall include, but not be limited to, single-family dwellings, two-family dwellings, multiple-family dwellings, mobile homes (whether located within or outside of a mobile home park or a seasonal mobile home park) roominghouses and boardinghouses.

    (b)

    Exceptions.

    (1)

    Single-family dwellings, which are rented for less than three months of any calendar year.

    (2)

    Multifamily apartment complexes, as long as they remain under the jurisdiction of and/or a financial obligation is owed to an agency such as HUD, MSHDA and FHA such as Leeson Court, Kirtland Terrace, Harbor View, Maple Hill Apartments, Lakeside Apartments, Cadillac Shores and Mayberry Apartments.

    (3)

    Roominghouses or boarding-type houses that are rented to only persons of the operator's immediate family, or not more than two persons not so related.

    (4)

    Transient rental dwelling units such as hotels, motels and bed and breakfast establishments.
